Terms & Conditions
Last updated: 9 October 2026
1. Who you are contracting with
These terms are between you and Hoiwa ("Hoiwa", "we", "us"), the seller and provider of the Hoiwa MedSafe online medication safety training platform (the "Service"). By creating an account, purchasing a course, or continuing to use the Service, you agree to these terms.
If you use the Service on behalf of an organisation, you confirm that you have the authority to bind that organisation to these terms. If you are an individual, you confirm that you are of legal age in your country.
Exam attempts
Each exam (for MCF: the theory exam, the calculation exam and the CNS exam) allows 3 attempts per course purchase or organisation licence. An attempt is counted when the exam is started. An attempt that is left unfinished is submitted automatically with the saved answers when the exam window ends.
After a failed attempt, the next attempt can start 5 full days (120 hours) later. After 3 failed attempts, the course must be purchased again (or your organisation can assign a new licence); a new purchase or licence gives 3 new attempts immediately. Passed exams stay passed. For free courses, a locked exam can be reset by the Hoiwa MedSafe team.
2. The Service
Hoiwa MedSafe provides online training courses in medication safety and medication calculations, including theory modules, practice exercises, supervised assessments, and completion records. Course content is educational material; it does not replace employer policies, local regulations, or clinical judgement.
We grant you a limited, non-exclusive, non-transferable right to access the courses you have purchased or been licensed to use, for your own learning, within the scope of your selected plan.
3. Acceptable use
You must not misuse the Service. In particular, you must not:
- use the Service for any unlawful purpose, fraud, or spam;
- infringe intellectual property rights, including copying or redistributing course content;
- interfere with the security of the Service, including introducing malware, probing, or scraping;
- reverse engineer the Service or circumvent technical limits;
- resell, sublicense, or share your account access with others;
- enter patient information or other third-party personal data into the Service.
You are responsible for keeping your account credentials confidential and for all activity under your account, and for providing accurate information and keeping it up to date.
4. Intellectual property
Hoiwa retains all ownership of the Service and its intellectual property, including software, course content, documentation, and branding. Nothing in these terms transfers any ownership to you.
5. Payments, billing and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, taxes, cancellation, and refund mechanics are governed by Paddle's Buyer Terms, available at https://www.paddle.com/legal/checkout-buyer-terms. Our own refund terms are set out in our Refund Policy.
6. Service level and warranties
We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
7. Liability
To the fullest extent permitted by law, we are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Our aggregate liability is capped at the fees you have paid to us in the 12 months preceding the claim. Nothing in these terms excludes liability for fraud, death, or personal injury where such exclusion is not permitted by law.
8. Suspension and termination
We may suspend or terminate your access to the Service in the event of a material breach of these terms, non-payment, a security or fraud risk, or repeated or serious violations of our policies. When access ends, your right to use the Service ends; completion records already issued remain valid according to their terms.
9. General
We are not liable for delays or failures caused by events beyond our reasonable control. You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. If any part of these terms is found unenforceable, the rest remains in effect.
